These Terms of Service (“Terms”) govern your access to and use of Phantomister websites, apps, bots, APIs, and related services (the “Services”). By using the Services, you agree to these Terms.

1. Eligibility and Accounts

You must be at least 13 years old (or the age required by your jurisdiction). You are responsible for the accuracy of information you provide and for safeguarding your credentials.

2. Acceptable Use

• No illegal activities, spam, malware, or attempts to probe/scan/overload our systems.
• No infringement of intellectual property or privacy rights.
• No use that violates third-party platform terms (e.g., Meta, Telegram, Google).

3. Integrations and Third-Party Services

Some features rely on third-party platforms and APIs. Their availability and terms are outside our control. Your use of those services is governed by their terms and policies.

4. Content and License

You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display your content solely to operate and improve the Services.

5. Intellectual Property

The Services and their original content, features, and functionality are owned by Phantomister and protected by IP laws. No rights are granted except as expressly stated.

6. Beta / Experimental Features

We may offer experimental features that may be incomplete or change at any time. They are provided “as is”.

7. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHANTOMISTER SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

9. Indemnification

You agree to defend, indemnify, and hold harmless Phantomister from any claims, damages, liabilities, costs, and expenses arising from your use of the Services or breach of these Terms.

10. Termination

We may suspend or terminate access to the Services at any time for any reason, including violation of these Terms. You may stop using the Services at any time.

11. Governing Law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles. Courts of Kyiv, Ukraine shall have exclusive jurisdiction, unless applicable law provides otherwise.

12. Changes

We may update these Terms from time to time. Continued use signifies acceptance of the updated Terms.
